Sacramento's street vehicle abatement rules

In the City of Sacramento, abandoned, wrecked, dismantled, inoperative or long-unregistered cars on public streets are nuisance vehicles, as is any car left unmoved for more than 72 hours. After a report, code enforcement tags the car with a Vehicle Violation Notice and Intent to Abate. The registered owner then has 72 hours to move it; if it's still there on re-inspection, it is towed and stored at the owner's expense.

Some cars don't get the 72 hours. A street-parked car that is hazardous, or whose registration expired more than six months ago, can be towed immediately without notice, and an immobilized car missing the parts it needs to run safely can be removed right away. In unincorporated Sacramento County, the county's code enforcement division enforces the same state rules on 72-hour parking, lapsed registration and abandoned or dismantled vehicles. If your car is on the street and won't run, selling it before the notice runs out avoids the tow and storage bill.

Car retirement programs open to Sacramento drivers

Sacramento's Clean Cars 4 All program, which helps income-qualified residents retire an old car and buy a cleaner one, paused new applications on June 7, 2024, and its page gives no reopening date. The statewide option still running is the Bureau of Automotive Repair's Consumer Assistance Program: $1,350 to retire a car that failed its most recent Smog Check, or $1,500 or $2,000 for income-eligible households.

CAP has strict conditions. You must be the registered owner with the title in your name, registration must be current or less than 120 days expired, and the car has to start without help and drive under its own power to a BAR-contracted dismantler — after you've received your eligibility letter. A car that doesn't run, is missing parts or has lapsed registration won't qualify; buyers on Reap My Ride make offers on those as they are.

Selling a junk car in California: the paperwork

Sign the title over

Sign the California Certificate of Title (pink slip) as the seller and hand it to the buyer at pickup, with the odometer reading filled in — federal rules require odometer disclosure for most transfers. If a lender is still listed, it has to release its interest first.

File your release of liability within 5 days

California law requires you to notify the DMV within 5 calendar days of the sale with a Notice of Transfer and Release of Liability (NRL, form REG 138). File it online and keep the confirmation — the record updates within one business day, and you're no longer liable for parking or traffic violations after the date of sale.

Leave standard plates on the car

Standard California plates generally stay with the vehicle; a licensed dismantler turns them in to the DMV or reports their destruction. Personalized, special interest and disabled person plates belong to you — take them off before pickup.

No smog certificate for a junk sale

A seller normally has to provide a smog certification, but that requirement doesn't apply when the car is sold to be legally wrecked or dismantled (CVC § 24007(b)). A car that failed its Smog Check can be sold as it is.

No title?

California has no true no-title sale for scrap. Apply for a replacement title with form REG 227 ($28), or sign a REG 227 and give it to a licensed dismantler in place of the lost title; a lienholder's release on it must be notarized. If the car was never transferred into your name, the buyer will need bills of sale showing the chain of ownership.

The City tagged my car with a 72-hour notice. What can I do?

Move it or sell it before the deadline. If it's still there when code enforcement comes back, it is towed and stored at your expense. Offers on Reap My Ride are typically valid for 5 days, so ask the buyer you choose for a pickup window inside the notice period.

Can my car be towed without any notice in Sacramento?

Yes, in some cases. A street-parked car whose registration expired more than six months ago, or one that's hazardous, can be towed immediately, and an immobilized car missing the parts it needs to run safely can be removed right away.

My car failed its Smog Check. Should I retire it through CAP or sell it?

If it still starts, drives and is registered in your name, compare CAP's $1,350 (up to $2,000 if you're income-eligible) with your offers. If it doesn't run or the registration has lapsed, it won't qualify for CAP — and it doesn't need a smog certificate to be sold for dismantling. Check what the metal alone is worth with the scrap value calculator.

Can I sell a junk car in Sacramento without a title?

Usually you need either the title or a workaround. Apply for a replacement with DMV form REG 227 ($28), or sign a REG 227 and give it to a licensed dismantler in place of the lost title. If you bought the car and never transferred it, keep the bills of sale showing the chain of ownership. See selling without a title.

What do I do with my California plates?

Standard California plates generally stay on the car, and the dismantler handles them with the DMV. Remove personalized, special interest or disabled person plates — those belong to you. Then file your Notice of Transfer and Release of Liability with the DMV within 5 days of the sale.
