Oklahoma City's 72-hour rule for inoperable cars

Oklahoma City's Municipal Code (Chapter 35, Section 37) declares an abandoned, inoperable or junked vehicle a public nuisance once it has been parked, stored or left on public or private property for more than 72 hours. Inoperative vehicles on private property can be towed.

Enforcement usually starts with a courtesy notice. Some cases start with a posted legal notice or a citation, and the City acts if the problem isn't fixed by the inspector's next visit. Complaints go to the OKC Action Center at (405) 297-2535, online at okc.gov/action or through the OKC Connect app. Parking on an unpaved surface is a separate violation (Chapter 59, Section 10250.8), so a car moved onto the grass doesn't help. If the car isn't going to run again, a sale and pickup closes the case.

Wrecked and flooded cars: Oklahoma salvage titles

In Oklahoma, a vehicle ten model years old or newer becomes salvage when the damage exceeds a set share of its fair market value at the time of loss. When an insurer pays that kind of loss, it must notify the owner and Service Oklahoma, and the owner surrenders the title to be replaced with a salvage title. If the insurer paid a loss on a car that was flooded to the dashboard or higher, the title carries a "Flood Damaged" notation. Vehicles more than ten model years old can go into or come out of salvage status at any time.

If your insurer paid out on a storm-damaged or wrecked car and you kept it, find out which title you hold before you sell. Tell buyers whether it is a standard, salvage or flood-damaged title. Buyers on Reap My Ride buy damaged cars either way, and honest details keep the offer the same at pickup.

Selling a junk car in Oklahoma: the paperwork

Sign the title in front of a notary

Sign the assignment on the back of the Oklahoma title. It includes a warranty of title and a statement of any liens, sworn before a notary. Hand the title to the buyer when the car is picked up.

Keep your plates

In Oklahoma, plates belong to the owner, not the car. Take them off before pickup. You can move them to another vehicle in the same registration class.

File a Notice of Transfer (optional)

Form 773 tells Service Oklahoma that you have assigned the car to someone else. It costs $10 and can be filed online through OkCARS, at a tag agency or by mail. It doesn't transfer the title. The buyer has 30 days to do that.

No title?

Oklahoma's Certificate of Ownership (SOK Form 766) covers a vehicle over 10 model years old that isn't roadworthy, or any vehicle sold to a scrap metal dealer. The dealer can't pay until the certificate has been submitted and the car is confirmed not stolen. A replacement title (Form 701-7) costs $11, or $12.73 by mail, and the vehicle's Oklahoma registration must be current.

How long can a dead car sit in Oklahoma City before it's a violation?

Not long. The city code treats an inoperable or junked vehicle left on public or private property for more than 72 hours as a public nuisance. Enforcement usually starts with a notice, so if you have one, accept an offer and schedule the pickup before the inspector comes back.

Can I sell a junk car in Oklahoma without a title?

Often, yes. Oklahoma's Certificate of Ownership (SOK Form 766) covers a vehicle over 10 model years old that isn't roadworthy, or any vehicle sold to a scrap metal dealer. If you can get a replacement title, it costs $11. See selling without a title.

Will I be paid at pickup if I don't have a title?

Maybe not right away. When a scrap metal dealer buys a car on a Form 766 certificate, Oklahoma bars it from paying until the certificate has been submitted and the car is confirmed not stolen. Ask your buyer when they will pay before you accept. With a signed, notarized title, payment is made at pickup.

Does my Oklahoma title need to be notarized?

Yes. The seller's assignment on the back of an Oklahoma title, including the statement of liens, is sworn before a notary. Get it notarized before the pickup.

What happens to my Oklahoma plates?

You keep them, because Oklahoma plates belong to the owner, not the car. Take them off before the tow and move them to your next vehicle in the same registration class. You can also file a Notice of Transfer (Form 773, $10) to record the sale with Service Oklahoma.
