Flooded cars after a Tampa Bay storm

FLHSMV treats a flooded car as totaled when repairs would cost 80 percent or more of its value, and a totaled car may not be offered for sale, sold or exchanged until a salvage application has gone to the county tax collector. If the car was insured, the insurer usually handles that after you assign the title to it. If it wasn't, the job is yours: Florida law (section 319.30) gives the owner 72 hours after the car becomes salvage to forward the title to FLHSMV, and the car can't be disposed of before a salvage title or certificate of destruction is issued.

Insurers brand flooded cars as salvage flood, and FLHSMV has to show the flood damage in a conspicuous place on the title (section 319.14(1)(b)). Dealers must disclose a brand in writing, and FLHSMV notes that cars aren't inspected before they are branded. If the title itself was lost in the storm, FLHSMV's disaster page lists emergency orders that waive replacement title fees for people affected, so check it before paying for a duplicate. On Reap My Ride, say how high the water reached and whether the title is branded, so the offer matches the car that gets picked up.

Inoperative cars in Tampa, St. Petersburg and Pinellas County

In unincorporated Pinellas County, a vehicle is inoperative if it can't be legally operated on the road (Sec. 58-270), and the County's examples include a cracked or missing windshield, broken lights, a flat tire and an expired tag. A car with only cosmetic flaws is fine if it works and has a current tag, and one kept inside an enclosed garage isn't a violation. Reports go to Code Enforcement at (727) 464-4761, the County's online complaint form or SeeClickFix; if the car is inside a city such as Clearwater or Pinellas Park, that city handles it.

St. Petersburg doesn't allow abandoned, disabled or inoperative cars to be parked anywhere in the City, and its codes staff list a car on private property that isn't street legal as a common violation. Auto parts and tires stored outdoors are prohibited too; the Codes Compliance Assistance line is 727-893-7373. Across the bay, Tampa's Neighborhood Enhancement Division takes abandoned or inoperative vehicle complaints at 813-274-5545 or through Tampa Connect, and it no longer accepts anonymous complaints. A car that only needs a tag renewal can still draw a case in Pinellas, so if it isn't worth renewing, selling it is the simpler fix.

Selling a junk car in Florida: the paperwork

Sign the title over

Complete the Transfer of Title by Seller section on the front of your Florida title, including the odometer reading, and hand it to the buyer at pickup. Keep a copy of the bill of sale; FLHSMV recommends having it notarized.

Keep your license plate

In Florida the plate stays with the seller, not the car, so take it off before the tow. Move it to another vehicle, or surrender it at a tax collector office or service center if you cancel the insurance tied to it or move out of state.

File a Notice of Sale within 30 days

Florida law requires sellers to file form HSMV 82050 within 30 days of the sale. It takes your registration off the car and helps protect you from civil liability for how it is used afterward.

No title?

If the car is at least 10 model years old (counting the model year as year one) and worth less than $1,000, you can sell it to a licensed salvage motor vehicle dealer or registered secondary metals recycler on a Derelict Motor Vehicle Certificate application (HSMV 82137), with a copy of your driver license. Otherwise, order a duplicate title through your county tax collector: the state fee is $75.25, plus a service fee.

My car flooded and it wasn't insured. Can I sell it as it is?

Not until the salvage step is done, if it's totaled. FLHSMV says an uninsured flooded car whose repairs would reach 80 percent of its value can't be sold until a salvage application goes to your county tax collector. Once you have the salvage title or certificate of destruction, Reap My Ride's local buyer can make an offer on it as it is.

Is a car with an expired tag a code violation in Pinellas County?

In unincorporated Pinellas County it can be. The County counts a vehicle that can't be legally driven as inoperative, lists an expired tag as an example, and exempts cars kept inside an enclosed garage.

Can I sell a car in the Tampa Bay area without the title?

If it's at least 10 model years old and worth under $1,000, yes: a licensed salvage dealer or registered secondary metals recycler can buy it on a derelict certificate application (HSMV 82137). A newer or more valuable car needs a duplicate title, which costs $75.25 plus a service fee unless an FLHSMV emergency order waives it after a storm. See selling without a title.

What happens to my Florida plate when the car is towed?

Take it off first, because Florida plates stay with the seller. Put it on another vehicle or surrender it if you're cancelling that insurance, and file a Notice of Sale (HSMV 82050) within 30 days. The Florida junk car guide covers the rest.
