Virginia Beach's inoperable vehicle ordinance

Virginia Beach City Code 16-40 requires vehicles to be in operating condition and to have either a valid state license plate or a valid inspection sticker, and they can't be in a dismantled or wrecked condition. Virginia law lets cities set rules like this for vehicles not kept in a fully enclosed building. The state statute treats a car as shielded from view only if it can't be seen by someone standing at ground level outside the property, and counts an inspection decal expired more than 60 days as a sign of an inoperable vehicle.

Code Enforcement allows seven days to correct most property maintenance violations. Ignoring a notice can bring a summons to General District Court, or cleanup by the City's contractor with the cost billed to the property owner and a lien placed on the property if the bill goes unpaid. Report a violation through VB311 by dialing 311 inside city limits, or 757-385-3111 from outside.

Flood-damaged cars in Hampton Roads

When an insurer pays a claim of $3,500 or more for water damage, Virginia Code 46.2-624 requires it to report the car to DMV. DMV then issues a new title with an indicator so the next owner knows, and that holds even if you keep driving the car.

If you keep a car after an insurance claim, the insurer files Form VSA 58, which cancels the current title and registration. What you send DMV depends on the box the insurer checked: a water-damaged car needs the notice, the current title and a $15 title fee; an unrepaired salvage car needs the same with a $15 salvage certificate fee; a nonrepairable car has no fee but can never be repaired for highway use, and it can't be titled in Virginia again.

Salvage status covers a late-model car (the current model year and the five before it) or one worth at least $10,000 before the damage, when repairs would cost more than its value minus its salvage value. Reap My Ride's local buyer makes offers on flooded cars; say how high the water reached and which title you hold so the offer reflects the real damage.

Selling a junk car in Virginia: the paperwork

Sign Section A of the title

Print and sign your name as seller in Section A on the front of the Virginia title. Every owner listed on the title must sign. Fill in the buyer's name and address, the actual odometer reading (don't estimate), the date of sale and the sale price.

Remove your plates

Take the plates off before the buyer takes the car. Move them to a replacement vehicle, or surrender them online, at a DMV customer service center or at DMV Select, and do it before you notify your insurer. With six or more months left on the registration, you may qualify for a refund with Form FMS-210.

Report the sale to DMV

Virginia requires you to report the sale, online, in person or by phone. If your insurer cancels coverage before DMV knows the car is gone, DMV records can show it as registered but uninsured, which can lead to suspension of your license and registration privileges.

No title?

Get a replacement before you sell. The fee is $15, and owners save $1 by requesting it online when nothing on the title needs to change; in person, bring your registration card and license. If a lien was paid off you need proof, or the new title goes to the lienholder.

Can I sell a junk car in Hampton Roads without a title?

Plan on replacing the title first. Virginia DMV charges $15 for a replacement, with $1 off online, and if an old loan isn't shown as paid, the new title goes to the lienholder. See selling without a title.

What do I do with my Virginia plates after the sale?

Remove them before the tow, then transfer them to another vehicle or surrender them to DMV before canceling your insurance. Report the sale to DMV as well, so your record doesn't show a registered car with no insurance.

Which cities does the local buyer cover in Hampton Roads?

Reap My Ride has a screened local buyer covering the cities of Virginia Beach, Norfolk, Chesapeake, Newport News, Portsmouth and Hampton, including Fort Monroe. Offers are typically valid for 5 days.

My car was flooded. Will the title be branded?

If your insurer paid $3,500 or more for water damage, it must report the car to DMV, and the next title carries a water-damage indicator. Reap My Ride's local buyer still makes offers on flood cars, so describe the water line and check what a junk car is worth.

How long do I have after a Virginia Beach code notice?

Most property maintenance violations have to be corrected within seven days. Ignoring the notice can lead to a General District Court summons or a City cleanup billed to the property owner.
